Spybot cannot fix item

I am posting in the malware forum about another issue and was advised to post the following information here. When I run Spybot, it finds two issues that it cannot fix. It states, "Some problems could not be fixed; the reason could be that the associated files are still in use (in memory). This could be fixed after a restart." I then restart and the same issues appear. Here is the text from the issues found (below). Do I need to worry about this?

You're running a very old outdated version of Spybot.Spybot 1.5 is available.

Here are some things you might want to do first,before uninstalling Spybot 1.3.

* Go into Spybot > Immunize
* Click "Undo" button (at the top)
* Uncheck (if checked) the following:
* "Enable permanent blocking of bad addresses in Internet Explorer"

* Go into Spybot > Mode > Advanced Mode > Tools > Resident
* Uncheck (if checked) the following:
* Resident "TeaTimer" (Protection of over-all system settings) Active.

Then you could uninstall Spybot from add/remove programs.

Based on past posts that might do it,but if not please post back,and I'll see if someone else here will have a look.
