About the update problem with the include files.
1. Did you really run the Update service elevated?
Did you open the Start Center or the SDUpdate.exe with a rightclick and choose "run as administrator"?
2. Did you only open the updater or click on "Check status"?
Or did you also click on "Update" manually after opening the Updater?

3. Can you post or send us the Event Log if there is any error of the Spyot Updates?
Click the Start button Picture of the Start button. In the Search box, type Event Viewer, and then, in the list of results, double-click Event Viewer.
4. We would also like to see the uid files.
They should be stored here:
"C:\Program Files\Spybot - Search & Destroy 2\Updates\Downloads\updates.uid"
5. Please restart the update service.
Therfore open the Settings -> System Services.
Click "Stop" - Apply - OK.
Open it again and press "Start" - Apply - OK.
6. Please run SDUpdate /noservice .
Make a desktop link for SDUpdate.
Then rightclick it and choose properties.
Add /noservice as command line parameter (with a blank space in front of the /).
7. Please check if SDUpdSvc is blocked by your firewall (if you run any).

I clicked on Update.
You should be able to reproduce the set up that I have exactly. Hopefully this will allow you to reproduce the problem. Here is what you need to do:
1. Install VirtualBox https://www.virtualbox.org/ I'm currently running v4.2.2, but I don't see why the latest version v4.2.4 should be any different.
2. Install the Windows 8 Release Preview 64 bit English version in a VirtualBox machine. I know that you keep going on about how Windows 8 hasn't been released, but I bet you have a copy of the release preview lying around .
Here is the basic set up. The only other thing that you might need to know is that I'm using the PIIX3 chipset and just one CPU.
3. Set up an administrator account and a user account using Microsoft accounts (rather than local accounts).
4. Install Spybot from the user account and test.
Alternatively, you could add some better logging as I suggested some time ago.
The only entries in the Event Viewer in the Application and Services Logs - Spybot - Search and Destroy section are information messages.
I've emailed this to you since I don't know what it contains.
This made no difference to the problem. I tested updating after restarting the service running as both user and administrator.

The first time that I ran it I used my user account. All that happened was that it checked whether there were any updates required and advised that 4 files needed updating. I still had to click the <Update> button to get it to try and download the new files and again this failed.
Note that the Windows Firewall did ask me to give SDUpdate access which I did, but I don't see why this would be unexpected since SDUpdate shouldn't have been asking for network access before.
The second time that I ran it I ran it as administrator. Again, it said that 4 files needed updating. I still had to click the <Update> button to get it to try and download the new files and again this failed.
I've given SDupdSvc explicit access through the Windows Firewall but this had made no difference, even after restarting Windows, and trying running as user and administrator.
But given that the update advises that 4 files need updating, doesn't this indicate that whatever needs access already has the access that it needs?

done both, makes no different, if i press the Update-Button or click Update (yes i click it!) i get the Connection-Error window!
no ,its not blocked and even if i shut down my firewall, i get the Connection-Error window!

@super0zero, drhughes (& @bbnetwork here or in the other thread): to further investigate this issue, could you open your browser and browse to http://127.0.0.1:21321/start , then post the output of that here (might take a moment to appear)?
That ensures we have the log of just one, current, attempt, as created by the update service, without conflicts from the user interface etc.
An example output could be:
Code:[+] Updating Service is active. [.] Trying to retrieve update info file from http://updates1.safer-networking.org/spybotsd2.uid... [+] Retrieved update info file. [.] Info file part done. [.] Testing which updates apply to this version... [.] Downloading updates... [+] All files have been processed. +++
